Terms of Service
The short version
- These terms cover the amplify.inc website. Using the Amplify platform is covered by a separate agreement between your business and us.
- You may browse and evaluate the Site; please don’t misuse it, scrape it, or break the law with it.
- The Site’s content and the “Amplify” name are ours. Pricing and product details may change and are not a binding offer.
- The Site is provided “as is,” our liability is limited, and Texas law governs.
These Terms of Service (“Terms”) are a legal agreement between you and Unchained Systems, Inc., a Delaware corporation operating in Texas (“Unchained Systems,” “we,” “us,” or “our”) governing your use of amplify.inc and its marketing pages (the “Site”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
1. The Site vs. the product
These Terms apply to your use of the Site only. Amplify is our software platform for multi-location salons and barbershops; access to and use of the Amplify platform is governed by a separate written agreement between your business and Unchained Systems, not by these Terms.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site. If you use the Site on behalf of a business, you represent that you are authorized to accept these Terms for that business.
3. License & acceptable use
We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for lawful business-evaluation purposes. You agree not to:
- misuse, overload, disrupt, or interfere with the Site or its infrastructure;
- attempt to gain unauthorized access to any system, account, or data;
- scrape, harvest, index, or copy content except as permitted by law or with our written consent;
- use the Site to build a competing product, or to train machine-learning models on our content, without our permission;
- remove or obscure any proprietary notices; or
- use the Site in violation of any applicable law or the rights of others.
4. Intellectual property
The Site and its content — including text, graphics, layout, design, images, and the names, logos, and marks “Amplify” and “Unchained Systems” — are owned by or licensed to Unchained Systems and are protected by intellectual-property and other laws. Except for the limited license above, no rights are granted to you, and all rights are reserved.
5. Feedback
If you send us ideas, suggestions, or feedback about the Site or Amplify, you grant us a perpetual, worldwide, royalty-free license to use them without restriction or obligation to you.
6. Informational content; no offer
Information on the Site — including product descriptions, features, pricing, and availability — is provided for general information, may describe plans or capabilities still in development, and may change without notice. Nothing on the Site is a binding offer, quote, warranty, or contract, and nothing creates a commitment to deliver any feature. Any purchase of Amplify is governed by the separate agreement referenced in Section 1.
7. Third-party links
The Site may link to third-party websites or services we do not control. We are not responsible for their content, policies, or practices, and a link is not an endorsement.
8. Privacy
Our Privacy Policy explains how we handle information collected through the Site and is incorporated into these Terms by reference.
9. Disclaimers
The Site is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, error-free, or secure, or that any information on it is accurate or complete.
10. Limitation of liability
To the fullest extent permitted by law, Unchained Systems and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, revenue, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Site — even if advised of the possibility. To the fullest extent permitted by law, our total liability for all claims relating to the Site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Unchained Systems and its personnel from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Site or your violation of these Terms or applicable law.
12. Governing law & disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. (Matters of our internal corporate governance remain governed by Delaware law, as for any Delaware corporation.) Before filing any claim, you agree to first contact us at [email protected] and attempt to resolve the matter informally for at least 30 days. Any unresolved dispute relating to the Site will be brought exclusively in the state or federal courts located in Bexar County, Texas, and you consent to their jurisdiction.
13. Changes to these Terms
We may update these Terms from time to time. Changes take effect when we post them and update the “Effective” date above. Your continued use of the Site after changes take effect means you accept the updated Terms.
14. General
These Terms, together with the Privacy Policy, are the entire agreement between you and Unchained Systems regarding the Site and supersede any prior understandings about it. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, financing, acquisition, or sale of assets.
